ZEMANN IP offers professional trademark applications in Austria at a fixed price from EUR 690 (plus VAT) per trademark.

Included are:

• Official fees for the registration.

• Examination of the trademark for absolute grounds for refusal (descriptive sign, lack of distinctiveness, generic terms, …).

• Identity search: Research for identical trademark registrations with protection in Austria (national Austrian trademarks, EU trademarks, and international registrations with protection in Austria).

• Preparation of the goods and services list.

• Preparation and submission of the trademark application at the patent office in the fast-track procedure (registration possible within a few days), provided that the requirements for the fast-track procedure are met.

• Correspondence with the patent office.

• Delivery of the registration certificate.

Add-ons:

• If you need protection for more than three classes, the fixed price increases by EUR 125 (plus VAT) per class. In most cases, three classes will be sufficient.

• If an online application is not possible, the fixed price increases by EUR 150 (plus VAT). For the most important types of trademarks (word marks, word-image marks, and image marks), an online application is generally possible.

• A trademark similarity search before application is useful, as not only older identical trademarks can be problematic but also older similar trademarks. ZEMANN IP offers the implementation of a trademark similarity search starting at EUR 400 (plus VAT).

• If ZEMANN IP is to take over trademark management and be entered in the register as a representative (including a reminder for renewal after 10 years), a surcharge of EUR 50 (plus VAT) will be charged.

Not included are:

• If there are objections from the Austrian Patent Office during the application process, for example, because the Austrian Patent Office considers the trademark not registrable, the related services will be charged at an hourly rate.

• If a third party files an opposition after registration (earlier rights are not examined by the Austrian Patent Office during the application process), the associated services will be charged at an hourly rate.
